L4J Public Comments on APS Proposed Rules Changes

Liberators for Justice has submitted the following public comments to the Federal Register in response to the Administration for Community Living’s (ACL’s) Notice for Public Rulemaking (NPRM) on regulating adult protective services (APS).

L4J welcomes this proposal for updated regulations as they will significantly impact how rights to self-determination and community living for people with disabilities are protected when APS investigates alleged maltreatment. L4J has found that APS investigations frequently lead to unnecessary guardianships and institutionalization. Our community is in dire need of stronger regulations that address such areas as conflicts of interest and that will mandate monitoring by Centers for Independent Living to ensure a consumer’s rights to self-determination and community living..

L4J invites organizations and individuals to use and adapt its public comments in their own submissions to the NPRM. These comments are due by noon Eastern Time, November 13.
